Judge Blocks Uncle Nearest Bankruptcy Filing in Ongoing Dispute

Uncle Nearest’s attempt to exit receivership through a Chapter 11 filing has been blocked in court. A federal bankruptcy judge in Tennessee dismissed the petition filed earlier this week, meaning the company remains under external control.
The ruling relates to filings made last week by founder Fawn Weaver, who had hoped the move would shift control of the business back to the company.

What led to the bankruptcy attempt

Earlier, Weaver shared on Instagram that the company had filed for Chapter 11 bankruptcy. She explained that the goal was to reorganise debt and protect employees, creditors, and shareholders.
In the same announcement, she stated that the receivership was “done,” suggesting the filing would bring the company back under founder control. Around the same time, she and her husband also confirmed legal action against lender Farm Credit Mid-America (FCMA), accusing the bank of spreading damaging claims about the brand.

Why the court rejected the filing

The issue came down to authority. Under the court’s existing order, only the appointed receiver, Philip Young, has the legal power to act on behalf of Uncle Nearest. This includes filing for bankruptcy. Because of that, Young quickly moved to challenge the petition, arguing it violated the court’s instructions.
An expedited hearing took place on March 19, 2026, where both the receiver and FCMA pushed for dismissal. The court agreed, and US District Judge Charles E Atchley Jr ruled that the filing could not stand. The bankruptcy case was dismissed, and Young remains in control of the company.

Ongoing dispute with the lender

The legal conflict between Uncle Nearest and FCMA has been building since mid-2025.
The lender claims the company owes more than 100 million dollar in loans and interest. It has also raised concerns about financial reporting, including alleged issues with barrel inventory and the handling of future revenue.
FCMA also pointed to a disputed $20 million loan linked to Jay-Z’s MarcyPen fund as part of its argument, describing it as evidence of improper conduct. The Weavers, however, continue to deny any wrongdoing and maintain that the accusations are false and damaging.

What happens next

For now, the receivership remains firmly in place under Philip Young, and control of the company has not changed.
The court is still expected to rule on whether the receivership should be expanded to include additional businesses connected to the founders. That decision could shape the next phase of the case.
As of now, Fawn Weaver has not publicly responded to the dismissal, and her earlier announcement about the bankruptcy filing remains live on Instagram.
